Heartsong Terms of Service

Welcome to Heartsong. These Terms of Service ("Terms") are an agreement between you and Heartsong Inc. ("Heartsong," "we," "our") covering the Heartsong iOS app, the Heartsong Apple Watch app, the Heartsong web app at console.myheartsong.app, and our public website at getheartsong.app — together, the "Service."

By downloading, installing, or using the Service, you agree to these Terms, and you accept them when you create an account. If you do not agree, do not use the Service.


1. Acceptance and eligibility

You must be at least 16 years old to use Heartsong. We ask for your date of birth when you create an account and use it only to apply these age rules; it is never shown to other members. If you are under 18, use Heartsong with a parent or guardian's involvement.

Public community features are for adults. Public groups and Open Circles (section 5.1) are available only to people 18 and over. Private groups and solo practice are available from age 16.

By using the Service you confirm that you have the legal capacity to enter these Terms, and if you are using it on behalf of an organization, that you have authority to bind that organization.


2. What the Service does

Heartsong is a generative biofeedback meditation app. It provides:

  • Generative soundscapes — music composed in real time from a library of audio stems, never a fixed recording. Every session is unique.
  • Biometric response — the music adapts to your heart rate and other health data from your Apple Watch or compatible devices.
  • Session history and insights — duration, heart-rate trends, Meditation Depth, Time to Calm, and related analysis.
  • Recordings — sessions saved as audio you can replay.
  • Sync — your sessions, recordings, and settings across your phone, your Watch, and the web.
  • Groups and chat — private groups you create or are invited to, public groups you can find and join, and Open Circles, with messaging and the ability to share soundscapes and Heartsongs.
  • The Meditation Room — a shared schedule in every group: any member can book a sit, once or on a repeating schedule, choose what the group meditates to, and everyone who joins begins together at the same moment, each hearing their own performance.
  • Sharing — links to your recorded sessions that you can send to anyone.
  • Notifications — group activity, reminders you opt into, and occasional announcements.

What is free and what is Premium. Meditating with Heartsong is free: the featured soundscapes are yours to download and play in full, at full quality, with the generative engine responding to your heart exactly as it does for anyone. Heartsong Premium adds the full soundscape library, Groups and Channels, Heart Insights and session history, and the Soundscape Designer. Every new account's first 30 days include Premium. See section 10.

We may change, add, or remove features; see section 13.


3. Accounts

An account is required. Using Heartsong requires an account, created with an email address and a password or with Sign in with Apple or Google. Your account is what carries your subscription, your session history, Community features, and the web app across your devices.

Your responsibilities. You agree to:

  • provide accurate information and keep it current;
  • keep your password confidential, and not share your account;
  • use one account per person, and not impersonate anyone;
  • tell us promptly at support@myheartsong.app if you believe your account has been compromised.

You are responsible for activity under your account.

Deletion. You can delete your account in the app. Deleting it erases your account, your sessions and recordings, and everything you posted in groups. Groups you own pass to another admin or are deleted. This is described in full in section 7 of our Privacy Policy. Please read it before deleting.

Deleting your account does not cancel your subscription. An App Store subscription is billed by Apple and can only be cancelled by you, in Settings → Apple Account → Subscriptions. We cannot cancel it for you, and Apple will keep charging until you do. Cancel first, then delete.


4. Your content

You keep ownership of your content — your notes, profile photo, display name, chat messages, custom soundscape configurations, and the recordings of your sessions.

To run the Service, you grant Heartsong a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, adapt for technical purposes such as format conversion and waveform generation, and display your content — but only as needed to operate, secure, and improve the Service and to deliver it to the people you shared it with. That license ends when you delete the content or your account, except for copies retained as described in the Privacy Policy and backups in their normal rotation.

Content you share into a group — a message, a soundscape or Heartsong card, a board post, a resource, or a soundscape you set as a sit's environment — is licensed to that group's members to view and, for soundscapes, to play within Heartsong for as long as it stays in the group; a soundscape a member has already imported stays playable on their device.

We will not use your content to advertise to you, sell it, or license it to third parties.

You represent that you have the rights to what you upload, and that it does not infringe anyone's rights or break any law.


5. Community, sharing, and conduct

Groups and Channels are part of Heartsong Premium (section 10), and every new account's first 30 days include them. This whole section applies whenever you have access to them. Sharing a session by link, described in 5.3, is available to everyone.

The Community Guidelines form part of these Terms. They are published at console.myheartsong.app/guidelines and describe how we expect people to treat each other in every shared space. We may update them; when their version changes you will be asked to read and accept the new version before your next public action. If the Guidelines and these Terms ever disagree, these Terms govern.

5.1 Groups

What you post in a group is visible to every member of that group, and joining a group makes your display name and profile photo visible to its members. In a private group, the owner and admins can also see your email address; in a public group, nobody else can.

Public groups and Open Circles can be seen from outside. Their name, description, picture, labels, size, upcoming sits, and the display name of the owner or host are visible to people who are not members, and a public group has a web page anyone can open. Their conversations are not visible from outside. Someone who takes a seat at a single sit sees who is in the room and its chat for that sit only.

People join a group only by accepting an invitation, using an invite code, or through a public group's join flow; nobody, including Heartsong staff, can add you to a group. A group's owner can invite members, remove anyone, promote and demote admins, and delete the group. An admin can invite members and remove plain members, but not another admin or the owner. An owner can hand the group to one of its admins. If an owner deletes their account, ownership passes to the longest-standing admin; a group with no other admin is deleted.

Chat is not end-to-end encrypted. Messages are encrypted in transit and at rest, but Heartsong holds the keys and can access message content where we need to — responding to an abuse report, complying with legal process, or debugging a defect you report. Please do not put anything in Heartsong chat that you would not want us able to read.

Messages persist. Leaving a group does not remove what you already sent; the conversation belongs to the group.

5.2 Invitations

Invite by email only people who would want the invitation. Inviting an address emails that person a link. It creates no account and no membership until they accept. Using invitations to send unsolicited mail violates these Terms, and we will act on it.

5.3 Shared links

A shared Heartsong link is public to anyone holding it. It carries the music, the heartbeat pulse track, the waveform, the date of the session, and your display name — and no biometric data. A link does not expire by itself. Deleting the session takes its link down, and deleting your account takes down every link you made. Once someone has opened or captured the audio, taking the link down cannot reach that copy; listen-only is an affordance, not copy protection.

Only share sessions you are comfortable making public, and only mint links for sessions that are yours.

5.4 Conduct

You agree not to use the Service to:

  • harass, threaten, bully, stalk, or abuse anyone;
  • post content that is unlawful, hateful, sexually exploitative, or that promotes self-harm or violence;
  • impersonate anyone, or misrepresent your affiliation;
  • send spam, chain messages, or unsolicited promotion, use invitations to reach strangers, or create accounts or groups in bulk;
  • share other members' personal information, or content from a private group, outside it without their consent;
  • post content you do not have the rights to, or infringe anyone's intellectual property;
  • present Heartsong's insights as medical advice to other users, or give medical advice through the Service;
  • reverse engineer, decompile, or disassemble the Service, or extract its audio library, stem metadata, or generative algorithms;
  • scrape, bulk-download, or redistribute content from the Service;
  • circumvent rate limits, tier limits, or access controls, or probe, disrupt, or overload our infrastructure;
  • access another user's account or data, or any part of the Service you are not authorized to reach;
  • remove or obscure copyright, trademark, or other proprietary notices.

Heartsong has zero tolerance for objectionable content and for abusive users. There is no strike count to spend: content that breaks this section comes down, and depending on what it was, the account behind it loses Groups, or loses Heartsong. Section 5.5 is how you tell us, and what we do about it.

5.5 Reporting and moderation

We have no tolerance for objectionable content or abusive users — and you do not have to wait on us in order to act.

Report any message, from inside the app. Long-press a message in a group and choose Report. Pick a reason — harassment, hate, sexual content, violence, self-harm, spam, or other — and add a note if there is something we should know. The report reaches Heartsong staff with a copy of the message as it stood when you reported it, so taking the message down does not erase the evidence. Reporting the same message twice does not open a second report.

Block anyone. Blocking hides that person and their messages from you in every group you share, on every device you sign in on. It is silent — they are not told — and it does not remove them from any group. You can unblock at any time.

Take a message down. You can remove any message you sent. A group's owner can remove anyone's message, and an admin can remove a plain member's. A removed message is gone from the conversation and from every device that syncs, but removal cannot reach a copy that has already left, such as a screenshot.

We filter some language before it posts. Text that matches a narrow list of disallowed language, such as slurs and explicit sexual solicitation, is refused rather than posted. A filter catches only the obvious cases; reporting and blocking are what protect people.

What we do with a report. Staff review every report, and we aim to act within 24 hours. Depending on what we find, we may remove content, remove someone from a group, revoke shared links, restrict features, or disable or terminate an account — for violating these Terms, or where we reasonably believe it is necessary for safety or legal compliance. Disabling an account also takes that account's shared links offline. Where it is practical and lawful, we will tell you why. Reporting something in good faith never counts against you; reporting in bad faith, to harass someone or to flood the queue, is itself a violation of section 5.4.

You can also email support@myheartsong.app — for anything that is not a message in a group, if a report needs context that will not fit in a note, or if you would simply rather write to a person. Use that address for urgent safety concerns.

5.6 The Meditation Room

Every group has a shared Meditation Room, where any member can book a sit, once or on a repeating schedule, and choose what the group meditates to.

  • Book only what you will lead. The person who booked a sit, and the group's owner and admins, can change or call it off.
  • Saying you are going schedules reminders, which arrive even during your quiet hours; change your answer or turn the reminders off to stop them.
  • The group sees who is in the room — by display name, and whether each person is settled, sitting, or done — and never anyone's heart data.
  • What the group meditates to is shared (section 4). Your own recording and insights stay yours, and sharing them is your choice.
  • The health disclaimer in section 8 applies to group meditations exactly as to solo ones. Do not join a sit while driving, and stop if you feel unwell.

6. Notifications

If you enable notifications, Heartsong sends push notifications for group activity, reminders for group meditations you said you are going to (on by default, and delivered even during quiet hours because you asked for that sit), notices about your account, and occasional announcements about the Service. The app has a switch for each kind of group notification, along with quiet hours, and you can turn all notifications off in the app or in iOS Settings. We do not send advertising or promotional notifications.

Turning off notifications does not stop us contacting you by email about your account, its security, or changes to these Terms.


7. Intellectual property

The Service — the audio stem library, the generative engine, the conductors and soundscape configurations we publish, the visual design, the interface, the name "Heartsong," and our logos — is owned by Heartsong Inc. and protected by copyright, trademark, and other laws. Some underlying methods are the subject of pending patent applications. Nothing in these Terms transfers any of it to you.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service on devices you own or control, for your own non-commercial use.

The music your sessions produce. Each session renders a unique performance for you. You may keep, replay, and share your recordings through Heartsong's own sharing features, and use them for your personal enjoyment. You may not commercially distribute, license, sell, publish them to streaming or content platforms, or use them in commercial productions without our prior written permission. Please ask — we are usually happy to talk about it.

If you believe content on Heartsong infringes your copyright, email support@myheartsong.app with enough detail to identify the work and the content.


8. Health disclaimer — please read

Heartsong is not a medical device. It is not intended to diagnose, treat, cure, prevent, or monitor any disease or health condition.

  • Heart rate, heart rate variability, respiration, Meditation Depth, Time to Calm, and every other figure Heartsong shows are for informational and wellness purposes only. They are estimates derived from consumer sensors, not clinical measurements, and they can be wrong.
  • Do not use Heartsong to make medical decisions, and do not rely on it to detect a medical condition or an emergency. Always consult a qualified healthcare professional.
  • If you have a heart condition, a seizure disorder, or a mental-health condition, talk to your clinician before using biofeedback or extended meditation practices.
  • Do not use Heartsong while driving or operating machinery, or in any situation where reduced alertness could be dangerous. Sleep and long-form sessions are designed to reduce arousal.
  • If you feel unwell, distressed, dizzy, or disoriented during a session, stop and seek help. Meditation can surface difficult emotional material, and Heartsong is not a substitute for therapy or crisis support.
  • In an emergency, call 911 or your local emergency number. If you are in crisis or thinking about harming yourself, call or text 988, the Suicide & Crisis Lifeline in the US, or contact local emergency services.

Heartsong is a wellness tool. Nothing in it, and nothing another user says in a group, is medical advice.


9. Improving Heartsong

Your heart rate and other readings shape the music as you meditate, your sessions stay in your account so you can follow your practice, and we use them to make your experience better, including, de-identified, to see how well the music is working and improve it. Section 3 of our Privacy Policy explains how, and how to ask us to leave your sessions out.


10. Plans and payment

Heartsong is free to use. Heartsong Premium is an optional paid subscription that unlocks four things:

  • the full soundscape library, beyond the featured set;
  • Groups and Channels, including the Meditation Room (section 5);
  • Heart Insights and session history, including your personal baselines;
  • the Soundscape Designer, for building soundscapes of your own.

Subscribing. Premium is sold as an auto-renewing subscription through the App Store, in a monthly or a yearly plan. The current price and duration are shown in the app before you confirm, and payment is charged to your Apple Account at confirmation of purchase.

Your free first month. Every new account's first 30 days include Premium, provided by Heartsong at no charge — no payment method is collected and nothing converts into a paid subscription automatically. When those 30 days end, your account moves to the free tier unless you choose to subscribe. This is granted once per account and is separate from anything billed by Apple.

Renewal and cancellation. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before that period ends. You can view, change, or cancel it at any time in Settings → Apple Account → Subscriptions on your device; cancelling stops future renewals and you keep Premium until the end of the period you have already paid for. We cannot cancel or refund an App Store subscription on your behalf.

Payment, refunds, and price changes. Apple is the seller for these purchases and bills you under Apple's terms. Fees are charged at the start of each billing period and are non-refundable except where the law requires otherwise or where Apple grants a refund; refund requests go to Apple. If we change the price, we will give you notice and, where Apple requires it, ask you to agree before the new price applies to you.

Access from other sources. Premium may also be provided to you without an App Store purchase — for example if an organization, retreat, or studio pays for your membership, or if we grant it directly. Access given that way is governed by the arrangement it came from rather than by this section, is not billed through Apple, and may end when that arrangement ends.

What the free tier is. After your first 30 days, and unless you subscribe, your account moves to the free tier. Meditating stays free and stays whole: the featured soundscapes download in full, at full quality, and the generative engine responds to your heart exactly as it does for a subscriber. What the free tier does not include is the four things listed at the top of this section. Nothing you created or recorded is deleted when your Premium access ends — your sessions, your designed soundscapes, and your groups are still there, and subscribing again restores access to them.


11. Third-party services

Heartsong depends on Apple for App Store distribution, HealthKit, and push notifications; on Google for Firebase Authentication and Google Cloud; on an email delivery provider; and on Lovable, which hosts our public website. Your use of Apple's and Google's platforms is also governed by their own terms. We are not responsible for third-party services, and outages in them can affect the Service.

Apple. These Terms are between you and Heartsong Inc., not Apple. Apple is not responsible for the Service or for support of it, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.


12. Privacy

Our handling of your information is governed by our Privacy Policy, which forms part of these Terms. Please read it — particularly the sections on what a shared link exposes, what other group members can see, what we store about your subscription (and why your payment details never reach us), and what account deletion does.


13. Availability and changes to the Service

We may modify, suspend, or discontinue any part of the Service, temporarily or permanently. We will give reasonable notice of a material change or discontinuation where we can, and where a change would remove access to your content, we will give you a reasonable opportunity to export it.

We are not liable for downtime, sync delays, missed notifications, or failures of your device, your Watch, your network, or third-party platforms.


14. Feedback

If you send us feedback or suggestions, we may use them freely, with no obligation or compensation to you.


15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that biometric readings, insights, or analytics will be accurate; that content will not be lost; or that defects will be corrected. We do not warrant any health or wellness outcome.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.


16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTSONG INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR PERSONAL INJURY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, ON ANY THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS.

We are not liable for what other users post or do, including content in groups, invitations, and shared links.

Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.


17. Indemnification

You agree to indemnify and hold harmless Heartsong Inc. from claims, liabilities, damages, losses, and reasonable legal fees arising out of your content, your use of the Service, or your violation of these Terms or of anyone's rights.


18. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access for violating these Terms, for conduct that risks harm to other users or to us, or where required by law — with notice where that is practical, and immediately where the situation requires it.

On termination, your license to use the Service ends. Groups you owned pass to another member as described in section 5.1. The provisions that by their nature should survive — the content license as scoped in section 4, intellectual property, the health disclaimer, disclaimers, limitation of liability, indemnification, and governing law — survive.


19. Changes to these Terms

We may update these Terms. We will move the "Last Updated" date, and for material changes we will notify you in the app or by email before they take effect. Continuing to use the Service after that constitutes acceptance. If you do not accept a change, stop using the Service and delete your account.


20. Governing law and disputes

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles. You and Heartsong agree to the exclusive jurisdiction of the state and federal courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing here deprives you of mandatory consumer protections in your country of residence.

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service.
